Brand refers to Vinny Fit, the operating brand of PlatinumCoaching, LLC.
Service refers to the Vinny Fit website, coaching programs, educational materials, and related services.

SMS messages are provided for informational and service-related purposes only and are not sent as unsolicited or cold outreach.

The Service may contain links to third-party websites or services that are not owned or controlled by the Company.

We are not responsible for the content, policies, or practices of any third-party websites or services.

Termination

Limitation of Liability

If liability is found, the Company’s total liability shall be limited to the amount paid by you for the Service, or one hundred U.S. dollars (USD $100), whichever is less.

SMS Messaging and Carrier Liability

By providing your mobile phone number and opting in to receive SMS messages from Vinny Fit, you acknowledge and agree to the following: Carrier Limitations and Disclaimers. SMS messages are transmitted through third-party wireless carriers and service providers. Vinny Fit is not responsible for any delays, failures, errors, or non-delivery of messages caused by your mobile carrier, network congestion, technical issues, or any other factors outside of our control. No Carrier Liability. You agree that your wireless carrier, and any other third-party telecommunications providers involved in the transmission of SMS messages, shall have no liability whatsoever for any claims, damages, or losses arising from or related to the SMS messaging service, including but not limited to the content, timing, delivery, or failure to deliver any messages. Message and Data Rates. Standard message and data rates may apply as determined by your wireless carrier. Vinny Fit is not responsible for any charges incurred from your mobile carrier in connection with receiving SMS messages. Device and Service Compatibility. Not all mobile devices or carriers may be compatible with our SMS messaging service. Vinny Fit makes no guarantees regarding compatibility, delivery, or functionality across all devices and carriers. Indemnification. You agree to indemnify and hold harmless Vinny Fit, its affiliates, and any third-party carriers or service providers from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the SMS messaging service or any violation of these terms. No Warranties. The SMS messaging service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. By opting in to receive SMS messages, you acknowledge that you have read, understood, and agree to these terms.

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied.

We do not guarantee specific results, outcomes, or health improvements from use of the Service. Educational and coaching content is not a substitute for professional medical advice.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Dispute Resolution

If you have a dispute or concern regarding the Service, you agree to first attempt to resolve it informally by contacting us.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
